These terms and conditions apply to the HollidaysFuel app (hereby referred to as "Application") for mobile devices that was created by Tri-State Fuel LLC (hereby referred to as "Service Provider") as a Free service.
Upon downloading or utilizing the Application, you are automatically agreeing to the following terms. It is strongly advised that you thoroughly read and understand these terms prior to using the Application.
Unauthorized copying, modification of the Application, any part of the Application, or our trademarks is strictly prohibited. Any attempts to extract the source code of the Application, translate the Application into other languages, or create derivative versions are not permitted. All trademarks, copyrights, database rights, and other intellectual property rights related to the Application remain the property of the Service Provider.
The Service Provider is dedicated to ensuring that the Application is as beneficial and efficient as possible. As such, they reserve the right to modify the Application or charge for their services at any time and for any reason. The Service Provider assures you that any charges for the Application or its services will be clearly communicated to you.
The Application stores and processes personal data that you have provided to the Service Provider in order to provide the Service. It is your responsibility to maintain the security of your phone and access to the Application. The Service Provider strongly advise against jailbreaking or rooting your phone, which involves removing software restrictions and limitations imposed by the official operating system of your device. Such actions could expose your phone to malware, viruses, malicious programs, compromise your phone's security features, and may result in the Application not functioning correctly or at all.
Please note that the Application utilizes third-party services that have their own Terms and Conditions. Below are the links to the Terms and Conditions of the third-party service providers used by the Application:
Please be aware that the Service Provider does not assume responsibility for certain aspects. Some functions of the Application require an active internet connection, which can be Wi-Fi or provided by your mobile network provider. The Service Provider cannot be held responsible if the Application does not function at full capacity due to lack of access to Wi-Fi or if you have exhausted your data allowance.
If you are using the application outside of a Wi-Fi area, please be aware that your mobile network provider's agreement terms still apply. Consequently, you may incur charges from your mobile provider for data usage during the connection to the application, or other third-party charges. By using the application, you accept responsibility for any such charges, including roaming data charges if you use the application outside of your home territory (i.e., region or country) without disabling data roaming. If you are not the bill payer for the device on which you are using the application, they assume that you have obtained permission from the bill payer.
Similarly, the Service Provider cannot always assume responsibility for your usage of the application. For instance, it is your responsibility to ensure that your device remains charged. If your device runs out of battery and you are unable to access the Service, the Service Provider cannot be held responsible.
In terms of the Service Provider's responsibility for your use of the application, it is important to note that while they strive to ensure that it is updated and accurate at all times, they do rely on third parties to provide information to them so that they can make it available to you. The Service Provider accepts no liability for any loss, direct or indirect, that you experience as a result of relying entirely on this functionality of the application.
The Service Provider may wish to update the application at some point. The application is currently available as per the requirements for the operating system (and for any additional systems they decide to extend the availability of the application to) may change, and you will need to download the updates if you want to continue using the application. The Service Provider does not guarantee that it will always update the application so that it is relevant to you and/or compatible with the particular operating system version installed on your device. However, you agree to always accept updates to the application when offered to you. The Service Provider may also wish to cease providing the application and may terminate its use at any time without providing termination notice to you. Unless they inform you otherwise, upon any termination, (a) the rights and licenses granted to you in these terms will end; (b) you must cease using the application, and (if necessary) delete it from your device.
Holliday's On-Demand Fuel Delivery Terms & Conditions
Thank you for choosing Holliday's On-Demand Fuel Delivery, a locally owned mobile fueling service proudly serving the Tri-State area. The following Terms & Conditions outline how our service operates, what you can expect when placing an order, and the responsibilities of both parties. By booking a delivery or using our website or mobile application, you acknowledge and agree to the terms outlined below.
1. Fuel Pricing & Payment
Fuel pricing is based on current local market rates and is subject to change without notice. At the time of booking, the total shown in the app reflects an estimated cost for the requested service.
Payment for the estimated total is authorized and processed at the time of booking through our secure third-party payment processor, Stripe. If the actual volume of fuel dispensed during delivery differs from the estimate, Holliday's On-Demand Fuel Delivery will adjust the final charge accordingly. Any applicable refunds or additional charges will be processed promptly following completion of service.
All transactions are encrypted and handled in accordance with PCI-compliant security standards.
2. Unattended Fueling Authorization
A valid, paid service request must be in place prior to any fueling activity.
By scheduling unattended service, you authorize Holliday's On-Demand Fuel Delivery to access and refuel your registered vehicle or equipment without your presence at the time of delivery. Customers are responsible for ensuring that the fueling location is safe, legally accessible, and free of hazards at the time service is scheduled.
Service may be delayed or unable to be completed if the vehicle, fuel door, fuel cap, or fueling location is obstructed, locked, unsafe, or otherwise inaccessible.
Holliday's On-Demand Fuel Delivery operates in compliance with all applicable standards established by the U.S. Department of Transportation (DOT), Occupational Safety and Health Administration (OSHA), Environmental Protection Agency (EPA), and National Fire Protection Association (NFPA) governing the transport and on-site dispensing of motor fuels.
Holliday's On-Demand Fuel Delivery is not responsible for pre-existing cosmetic or mechanical damage observed following service.
3. Customer Responsibilities
Customers are responsible for providing accurate booking details, including the correct service address, fuel type, and vehicle description. Vehicles or equipment must be legally parked at the specified location on the scheduled service day. Holliday's On-Demand Fuel Delivery is not liable for damage resulting from incorrect or incomplete information provided by the customer, including but not limited to fuel type selection.
Customers must ensure that the fuel door is unlocked and accessible prior to delivery. Holliday's On-Demand Fuel Delivery does not open or manipulate locked fuel doors. An attempted service fee may be assessed if fueling cannot be completed due to a locked or inaccessible fuel door.
Holliday's On-Demand Fuel Delivery is not responsible for pre-existing leaks, damage, worn components, or fuel system issues. Service may be declined if a vehicle appears unsafe or incompatible with fueling equipment.
4. Scheduling, Cancellations & Service Attempts
Cancellations or reschedules may be made within ten (10) minutes of booking at no charge. Requests made after this time may be subject to a cancellation fee.
If service cannot be completed due to customer-related issues such as an incorrect address, inaccessible vehicle, or locked fuel door, an attempted service fee may apply.
Holliday's On-Demand Fuel Delivery reserves the right to pause or reschedule service due to severe weather, traffic conditions, safety concerns, or other circumstances beyond our control.
Fuel deliveries are performed within a general service window and are not scheduled for a specific time unless otherwise agreed in writing.
5. Service Limitations
Holliday's On-Demand Fuel Delivery primarily services registered vehicles. Approved containers or tanks may be filled provided they are present and accessible at the same scheduled time and service address as the registered vehicle.
Emergency roadside or hazard response services may be offered in certain circumstances and are subject to a separate pricing structure.
Holliday's On-Demand Fuel Delivery reserves the right to refuse service if the vehicle, container, or fueling location presents a safety concern or does not meet operational requirements.
6. Liability
Holliday's On-Demand Fuel Delivery assumes no responsibility for damages resulting from faulty or compromised fuel systems, pre-existing leaks, or misuse of delivered fuel.
Holliday's On-Demand Fuel Delivery assumes no liability for delays or missed service caused by environmental conditions, traffic disruptions, or third-party interference. Holliday's On-Demand Fuel Delivery does not guarantee that a vehicle or container will be filled to capacity due to system limitations, safety shutoffs, or equipment compatibility.
In the rare event of a fuel spill, Holliday's On-Demand Fuel Delivery follows established containment and cleanup procedures in accordance with applicable environmental safety standards. In the event of a spill resulting from a pre-existing vehicle defect, compromised fuel system, or inaccessible fueling port, Holliday's On-Demand Fuel Delivery shall not be held responsible for environmental remediation or cleanup costs.
7. Privacy
We collect only the information necessary to schedule and complete your fuel delivery. This may include contact details, vehicle information, and payment authorization.
Your information may be used to:
- Process and complete service requests
- Provide order confirmations and service updates
- Improve service performance and customer experience
Payment data is processed securely by Stripe in accordance with PCI-DSS Level 1 standards. Holliday's On-Demand Fuel Delivery does not store full credit card information.
We do not sell or rent your personal data. Information is shared only with trusted service partners essential to operating our platform.
